Local Law 122 of 2023

Annual Notice and Investigation Records

You'll need to provide annual notice and investigation records if there are any lead-based paint hazards or turnover violations. This requirement starts on September 1, 2024. Starting in August 2025, you must also keep XRF testing records handy and provide them whenever there's a lead-based paint hazard or turnover violation. This is a critical step in ensuring compliance with the new regulations.

XRF Testing of Common Areas

Complete XRF testing in common areas by August 2025, and keep these records to submit to HPD upon request. Remember, all apartments must be tested by this deadline as well. HPD advises property owners to seek exemptions for any areas without lead-based paint or where lead paint has been successfully removed.

Deadline: August 2025
Requirement: Conduct XRF testing in common areas and maintain records. All apartments must be tested by this date.
Exemption Advice: Apply for an exemption for areas that test negative or where lead-based paint has been abated.

Local Law 123 of 2023

Lead Paint Abatement and Remediation

Under Local Law 123 of 2023, property owners must address lead-based paint hazards in certain situations to protect young children. If a child under six years old lives in a unit suspected of having lead-based paint, and the building was built before 1960 or is a private dwelling constructed before January 1, 1960, then by January 1, 2025, the owner is required to remove lead paint from door and window areas and make sure that all floors are smooth and easy to clean by July 2027. Additionally, if a child under six moves into such a unit after January 1, 2025, the property owner has three years from the child's move-in date to complete these remediations.

For Existing Units with Children Under Six: Abate and remediate by July 2027.
For New Residencies of Children Under Six After January 1, 2025: Complete abatement and remediation within three years of the child moving in.
Requirement: Focuses on abating lead-based paint on friction surfaces (doors and windows) and making all floors smooth and cleanable.
